Client Alert: California Publishes Draft List of 4,160 Companies Under Climate Disclosure Laws

The California Air Resources Board (CARB) has published a preliminary list of 4,160 companies that may be subject to: SB 253 or SB 261. The list also shows whether a company is flagged for SB 261 only or for both SB 261 and SB 253. The list can be found at the link below.

A few notes from KERAMIDA:

  • The list was built using California Secretary of State (SoS) filings (through March 2022) and name-matching across datasets. So some companies may be missing or mismatched. 

  • It is meant to help develop the fee regulation. Each company is still responsible for compliance, whether it appears on the list or not.

  • Exemptions discussed at CARB’s workshops are not yet reflected.

  • CARB is seeking stakeholder feedback. Companies that think they’re in scope (or may qualify for an exemption) are encouraged to complete the voluntary survey below.
