/KERAMIDA Provides Testimony Before the House Environmental Affairs Committee of the Indiana General Assembly
Lauren Nielsen, P.E., Senior Engineer, of KERAMIDA, testified before the House Environmental Affairs Committee of the Indiana General Assembly regarding pending environmental legislation, Senate Bill 277 (SB 277), which proposes significant amendments to Title 13 of the Indiana Code.
Due to the large number of individuals providing testimony, speakers were limited to two minutes. Lauren focused her remarks on two key technical areas identified in KERAMIDA’s recent Client Alert:
The need for a clear definition of “reportable quantity” for petroleum releases under IC 13-23-13, particularly given that petroleum is excluded from federal hazardous substance definitions referenced elsewhere in statute.
Support of striking proposed language authorizing IDEM to impose restrictive covenants under IC 13-25-4-11, to properties where contamination has migrated, and the landowner is not responsible for the release.
Following the hearing, Lauren continued discussions with representatives from IDEM, environmental attorneys, and advocacy organizations. These conversations addressed important scientific considerations relevant to implementation of the bill, including PFAS fate and transport and LNAPL Natural Source Zone Depletion (NSZD), contributing additional scientific context to the policy discussion.
